1. Promoter
The Promoter is Rift Design, a registered business name operating in Victoria, Australia.

All references to “we”, “us”, or “our” in these Terms & Conditions refer to the Promoter.
This promotion is conducted in Australia and governed by the laws of the State of Victoria.2. Contest Period
The Contest commences at 12:00am AEST on the first calendar day of each calendar month and closes at 11:59pm AEST on the last calendar day of the same month (“Entry Period”). The first Entry Period will commence on [Insert Start Date]. The Promoter reserves the right, at its sole discretion, to cancel, suspend, extend or modify the Contest or any Entry Period at any time (see Clause 16) without prior notice.3. Eligibility
3.1 Entry is open only to natural persons who:
a) are residents of Australia and reside in Australia during the Entry Period;
b) are 18 years of age or older at the time of entry;
c) are not employed by, hired by, or contracted with the Promoter or any of its agencies, subsidiaries, or any entity directly involved in the administration of this Contest; and are not immediate family members (spouse/partner, parent, child, sibling) of such persons.
3.2 By entering, each entrant warrants they meet all of the eligibility requirements and consents to being bound by these Terms & Conditions. Entrants self-declare eligibility via the entry form checkbox; the Promoter reserves the right to request proof only where necessary to confirm eligibility.
3.3 The Promoter may in its absolute discretion exclude any entrant if it reasonably considers the entrant is ineligible for any reason, or if the entry is fraudulent, altered or misrepresented.4. Entry Conditions & How to Enter
4.1 To be eligible, during the Entry Period the entrant must complete all of the following steps:
a) take an original photo or short video which clearly features a Rift Design product in actual use or situational display (rather than merely packaging or placeholder), demonstrating the product is identifiable and used in an outdoor/adventure context;
b) post that photo or video publicly on a supported social media platform (see Clause 5) including in the caption both hashtags #RiftDesign and #ShowYourRift, and tag or mention the Promoter’s official social media account (for example, @riftdesign) where applicable;
c) ensure the social media post is publicly accessible (i.e., the post’s privacy settings allow the Promoter to view it) and remains publicly accessible for a minimum of thirty (30) days following submission so the Promoter may verify and use the content;
d) complete and submit the official Contest entry form (accessible via the QR code on packaging, or via the link at (http://go-riftdesign.com.au/) during the Entry Period, providing at minimum: first name (and initial surname if desired), a valid email address, and the link to or handle of the relevant social media post. Optional: phone number for winner contact.
4.2 The Promoter accepts up to two (5) valid entries per person per Entry Period. Each entry must be a separate unique social media post that meets the requirements in Clause 4.1. Multiple posts which are substantially the same or minor variants may be disqualified at the Promoter’s discretion.
4.3 Entry is free. No payment or purchase is required to enter, apart from usual internet or mobile-data costs. Although entrants must feature a Rift Design product in their content, such product may be owned, borrowed, gifted, or otherwise lawfully used. No product purchase is required or implied for entry eligibility, and entrants are not disadvantaged for using a borrowed or gifted item.
4.4 Entries received after the closing time for the Entry Period will not be eligible for that month's judging but may be eligible for subsequent Entry Periods if re-submitted and the entrant meets all requirements for that next period.
4.5 The Promoter may limit or refuse entry at its absolute discretion (for example in the event of suspected fraud, system failure, bot entries, manipulation of hashtags, or similar) and may reject any entry that is incomplete, illegible, or fails to comply with these Terms & Conditions.5. Social Media Platforms & Content Conditions
5.1 The Contest allows entry via the following supported social media platforms: Instagram, TikTok, Facebook, YouTube (or any other platform designated by the Promoter and referenced in promotional materials). By entering via one of these platforms, entrants agree to comply with that platform’s terms of service, community guidelines, privacy settings, and any other applicable policies.
5.2 The Promoter is not affiliated with, sponsored by, or endorsed by any of these platforms. The entrant releases each platform from any and all liability in connection with this Contest.
5.3 Each social media post must:
a) be the entrant’s own original work (photo/video) and not infringe any third-party intellectual property rights, rights of publicity, privacy rights, trademarks, copyright, or other rights;
b) not feature any third party’s identifiable minor (under 18) without verifiable consent of their parent/guardian;
c) not feature any offensive, violent, defamatory, obscene, discriminatory, unlawful or inappropriate content;
d) prominently display or clearly represent the Rift Design product (logo visible or recognisable) and reflect the outdoor/adventure use of such product;
e) include the required hashtags and social tags as set out in Clause 4.1;
f) remain publicly accessible for at least thirty (30) days following entry for verification and possible promotional use.
5.4 The Promoter reserves the right to remove any entry, invalidate it, or disqualify participation if it believes the entry fails to comply with platform rules, these Terms & Conditions, or otherwise compromises the fairness or integrity of the Contest.
5.5 Entrants must ensure their social media account remains active and accessible through the verification period. The Promoter is not responsible for any deleted, hidden, or inaccessible posts or accounts which affect eligibility.6. Judging & Winner Selection
6.1 This Contest is a game of skill. The winner is chosen by judging and not by chance. There is no random draw element. This classification is intended to avoid the regulatory burdens associated with games of chance or trade promotion lotteries.
6.2 Judging panel: The winner will be selected by the Promoter, or by the Promoter together with a nominated independent person (“Judging Panel”). The Promoter may at its absolute discretion determine to involve such a third-party judge, though it is not required.
6.3 Judging criteria – each eligible entry will be assessed on the following basis:
a) Creativity & originality – 40% - Uniqueness of the photo/video concept and storytelling.
b) Visual quality, photography or videography and storytelling – 30% - Clarity, lighting, and overall quality of the imagery.
c) Relevance and demonstration of Rift Design product in an outdoor/adventure setting – 30%
6.4 The Promoter’s or Judging Panel’s decision is final and binding, and no correspondence will be entered into.
6.5 The Promoter reserves the right not to award a prize if, in its reasonable opinion, no entry sufficiently meets the judging criteria. If no eligible entry is received during a given Entry Period, no prize will be awarded for that period.
6.6 The judging will take place within five (5) business days of the closing of the Entry Period and the winner will be notified within seven (7) business days of the judging.
6.7 The Promoter shall maintain records of entries and the judging process (e.g., notes, scoring sheets) for a minimum of twelve (12) months following the awarding of the prize to demonstrate compliance, fairness and transparency.7. Prize
7.1 Prize. Each Entry Period’s prize consists of one (1) Rift Design promotional store-credit code valued at AUD $50 (inclusive of GST). This code is emailed to the winner, redeemable once within 30 days of issue, holds no cash value, and cannot be transferred or exchanged.
If Rift Design ceases trading or the online store becomes unavailable, unredeemed promotional codes will automatically expire, and the Promoter will have no further liability or obligation to provide a replacement or refund.
7.2 The Promoter may substitute the specified prize with another prize of equal or greater value if the advertised prize becomes unavailable, at its discretion, but the value will remain approximately AUD $50 unless otherwise advertised in advance.
7.3 The prize is not transferable, cannot be exchanged for cash, and must be used in accordance with the Promoter’s standard voucher/credit terms.
7.4 Limit of one prize per person per Entry Period. A previous winner may enter again in a subsequent month but cannot receive more than one prize in the same Entry Period.
7.5 All prize values are stated in Australian Dollars and include GST where applicable. Shipping is included at no cost to the winner.
7.6 The Promoter reserves the right to vary (increase or decrease) prize value or quantity in future Entry Periods, or to discontinue offering the prize altogether, at its sole discretion. Any such variation will be published in these Terms & Conditions and on the Contest landing page prior to the Entry Period.
7.7 The total annual prize pool (over a 12-month run) will not exceed AUD $600 unless otherwise publicly announced.8. Winner Notification & Claiming
8.1 The winner will be notified by email to the address provided on their entry form within seven (7) business days of the judging being completed. The Promoter may also contact the winner via direct message on their social media handle.
8.2 The winner will be notified by email to the address provided on their entry form, or via direct message on the social media platform used to submit their entry, within seven (7) business days of judging completion. Where no additional verification is required, the store-credit code will be issued directly via email without the need for further confirmation.
The Promoter reserves the right to request proof of identity, age, or residency at its discretion before or after issuing a prize if verification is deemed necessary (for example, suspected duplicate or fraudulent entries).
Failure to provide satisfactory verification when requested may result in forfeiture of the prize.
8.3 By entering, entrants confirm they are 18 years or older and reside in Australia by ticking the declaration checkbox on the entry form.
The Promoter may request supporting identification (such as a driver’s licence or passport) only if necessary to verify eligibility or resolve a dispute before awarding a prize.
Failure to respond to a reasonable verification request within seven (7) business days may result in forfeiture of the prize and selection of an alternate winner.
8.4 Prizes are delivered via email to the winner’s nominated email address (for store credit) or by post (for physical items). Store credit codes are issued within seven (7) business days of judging completion and must be redeemed within thirty (30) days. The Promoter takes no responsibility for any delays, loss or damage once the prize has been sent. If a winner fails to redeem the prize within the specified timeframe, the prize will be forfeited and the Promoter has no further obligation.
8.5 The Promoter is not responsible for any lost, stolen or damaged prize once it is delivered to the winner’s nominated address or email inbox.9. Publication & Publicity
9.1 By accepting the prize, the winner consents to the Promoter publishing their first name, state of residence (e.g., “VIC”), social media handle, photo/entry, and prize won, on the Promoter’s website, social media channels, promotional emails and future advertising materials, worldwide, for an unlimited period, without further payment or compensation.
Winners consent to the Promoter publishing only their first name and/or social-media handle and state of residence for public announcement and marketing purposes. Full names or personal contact details will not be publicly disclosed.
9.2 The winner further agrees to reasonably cooperate with the Promoter’s promotional activities following winning (such as providing a photo of themselves with their prize or engagement for social media) at no additional cost to the winner.
9.3 The Promoter reserves the right to promote non-winning entries (for example via “popular entries” or “runner up gallery”) but is not obliged to publish any such material.10. Intellectual Property & Licence
10.1 By submitting an entry, each entrant warrants that:
a) they are the sole creator and owner of the entry (photo/video) and all rights in it (including moral rights) are either waived or cleared;
b) the entry does not infringe any third-party rights (including privacy, publicity, copyright, trademark or design rights);
c) all persons depicted in the entry (and, where applicable, minor’s parents/guardians) have provided their consent to the entrant for the entry’s submission and use by the Promoter;
d) any background music, third-party imagery or likenesses included in the entry are either original or licensed for use by the entrant and the Promoter.
10.2 Each entrant grants the Promoter a non-exclusive, worldwide, perpetual, royalty-free, irrevocable licence to use, reproduce, publish, modify, adapt, transmit, display and sublicence the entry (in whole or part), including the entrant’s name/handle, for advertising, promotional or other business purposes in any media, with or without attribution. The Promoter may edit or crop the entry for consistency and brand use.
10.3 The entrant agrees that they will not use their entry for any other commercial purpose without the Promoter’s written consent.
10.4 The Promoter is not obligated to use any entry beyond the effecting of the prize and its own promotional efforts; no entrant will receive separate remuneration for promotional use of their submitted content.11. Privacy & Data Collection
11.1 The Promoter collects personal information from entrants (such as name, email, social handle, residential state) for the primary purpose of administering the Contest and contacting the winner.
11.2 The collected personal information will be stored securely in encrypted Google Sheets or other secure data storage accessible only to authorised personnel of the Promoter.
11.3 The personal information will be retained for a period of no more than twelve (12) months following the relevant Entry Period, unless the entrant opts-in to receive further marketing communications, in which case their information may be retained in accordance with the Promoter’s privacy policy. After the retention period the data will be deleted or anonymised.
11.3A The Promoter may collect non-identifiable information about how visitors interact with the Rift Design website and promotional landing pages, including via QR code scans, cookies, and analytics tools. This may include device and browser details, time on page, and general location. Such information is collected in anonymised or aggregated form and does not personally identify individuals. The Promoter uses this data to analyse engagement and improve products, promotions, and customer experience, and may use trusted third-party analytics providers (for example, Google Analytics and Short.io Analytics) which process data in accordance with their own privacy policies.
11.4 The Promoter will comply with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). The Promoter’s Privacy Policy is available at Privacy Policy.
11.5 Entrants may request access to, correction of or deletion of their personal information held by the Promoter by emailing [Insert Contact Email].
11.6 Entry into the Contest does not automatically subscribe the entrant to marketing communications unless they separately opt-in to receive such communications. Entrants who opt-in may unsubscribe at any time.
12. Liability & Release
12.1 To the fullest extent permitted by law, the Promoter (including its officers, employees, agents and contractors) will not be liable for any loss, damage, cost or expense of any kind (including indirect or consequential loss, or loss of profits, or data loss) suffered or incurred by an entrant or winner arising out of or in connection with:
a) participation in the Contest or entry into the Contest;
b) any act or omission of the Promoter in relation to the Contest;
c) acceptance, use, misuse or non-use of the prize;
d) any change or variation to the prize, or cancellation or modification of the Contest pursuant to Clause 16.
12.2 Nothing in these Terms & Conditions excludes, restricts or modifies any non-excludable consumer rights under the Competition and Consumer Act 2010 (Cth) (including the Australian Consumer Law) or any corresponding state fair trading legislation. If any provision would contravene any such law then that provision shall be read down or severed to the minimum extent required to remain valid.
12.3 Entrants indemnify the Promoter against any loss or claim (including legal costs) made by any third party arising out of the entrant’s content submission (including infringement of third-party rights) or their breach of these Terms & Conditions.13. Social Media Platform Terms
13.1 This Contest is in no way sponsored, endorsed or administered by Instagram, TikTok, Facebook, YouTube or any other social media platform used by the Promoter.
13.2 By participating in the Contest, entrants release each such platform from all liability in connection with the Contest and agree to comply with all applicable platform rules and policies.
13.3 The Promoter may tag or mention platform pages or handles solely for promotional purposes; such tags or mentions do not imply any relationship or endorsement by the platform.
13.4 Where entries are posted on a platform, the entrant agrees that the platform’s data collection, privacy practices, advertising or algorithmic exposure are not the responsibility of the Promoter.14. Amendments & Variation
14.1 The Promoter may, at its absolute discretion, cancel, suspend or modify the Contest or these Terms & Conditions at any time (including changing the entry mechanics, prize, judging process or Entry Period) where it reasonably considers that circumstances beyond its control make it necessary (for example technical fault, fraud, regulatory change, or insufficient entries).
14.2 If the Contest landing page or the Promoter website becomes unavailable for any reason, or if any printed or digital QR code ceases to function, all promotional obligations will end once a notice of closure is published or, where no notice is possible, upon website unavailability.
14.3 Any variation to these Terms & Conditions will be published on the Contest landing page and will apply from the date of publication. The version date of these Terms & Conditions will also be updated. It is the entrant’s responsibility to review the Terms & Conditions each time they enter.15. General
15.1 If any provision of these Terms & Conditions is invalid, illegal or unenforceable in any jurisdiction, it shall be deemed to be severed to the minimum extent necessary without affecting the remaining provisions.
15.2 Headings are for convenience and do not affect interpretation.
15.3 These Terms & Conditions, together with the entrant’s submission and the promotional materials, form the entire agreement between the entrant and the Promoter in relation to the Contest and supersede all prior and contemporaneous communications, representations or agreements.
15.4 The Promoter’s failure to enforce any right or provision of these Terms & Conditions does not constitute a waiver of that right or provision.
15.5 The Promoter may assign, delegate or subcontract its rights under these Terms & Conditions without the entrant’s consent.
15.6 The Promoter makes no undertaking that any promotional or advertising exposure will occur, beyond its usual business practices, and entrants acknowledge that accepting a prize does not guarantee future business or engagement by the Promoter.16. Governing Law & Dispute Resolution
16.1 These Terms & Conditions are governed by the laws of the State of Victoria, Australia.
16.2 Entrants submit to the non-exclusive jurisdiction of the courts of Victoria, Australia.
16.3 If the entrant is a “consumer” under the Australian Consumer Law (ACL), nothing in these Terms & Conditions limits or excludes the entrant’s rights under the ACL or any applicable state consumer protection law.
16.4 The Promoter will comply with any regulatory obligations under the legislation of each Australian state and territory in which the Contest is conducted (including but not limited to the Gambling Regulation Act 2003 (Vic), Community Gaming Act 2018 (NSW), Lotteries Act 2019 (SA)) as they apply to games of skill or trade promotions.17. Cost of Entry
No purchase is required to enter. Entry is free beyond the cost of the entrant’s personal internet usage or standard mobile phone/internet charges. Any additional costs (for example obtaining a product if an entrant chooses to do so) are the entrant’s responsibility and cannot be reimbursed.18. Identification & Age Verification
18.1 Entrants must declare, by checkbox acknowledgment at the time of entry, that they are 18 years or older and resident in Australia.
The Promoter may request supporting identification only if there is reasonable doubt about eligibility or a dispute arises regarding the winner’s identity.
Proof may include a driver’s licence or passport. Entrants who cannot supply proof within seven (7) business days of request may forfeit the prize.
No routine upload or submission of ID is required to enter.
18.2 If the winner cannot or does not provide proof within seven (7) business days of request, the Promoter may forfeit the prize and select an alternate winner under Clause 8.19. Unclaimed Prize
If the winner fails to claim the prize in accordance with Clause 8, the Promoter may at its discretion select an alternate winner based on the same judging criteria and the original entries from that Entry Period. The original entrant will forfeit all entitlement to the prize.20. Additional State-Specific Compliance
20.1 The Promoter has structured the Contest as a game of skill (no element of chance) and thereby does not require trade promotion lottery permits in Victoria, Queensland, Western Australia, Tasmania or any other jurisdiction where games of skill are unregulated. adma.com.au+1
20.2 The Promoter’s decision-making processes seek to comply with the most stringent regulatory requirements across Australian states (including NSW, ACT, SA, NT) so as to minimise risk of classification as a game of chance. For example: there is no random draw tie-breaker; multiple entries per person are allowed but each entry is judged on its merits; any tie is resolved via additional judging, not by chance.
20.3 Packaging and QR Reference. Promotional packaging may include a QR code or link directing customers to a general landing page labeled “Scan for current offers,” accompanied by the disclaimer “Content may change or end without notice. Full details & T&C online.” The landing page will specify whether an active promotion or contest is running and will display the latest Terms & Conditions. If no active offer exists, the page will state this clearly. If the Contest landing page or QR code is discontinued or replaced, or if Rift Design ceases trading, no further obligations exist in respect of packaging, QR codes, or printed promotional material still in circulation. The Promoter will ensure all required disclosures (e.g., under SA Lotteries Act 2019 Reg 30) remain visible online.
20.4 The Promoter will keep full records of all entries, judging decisions, winner notifications and prize fulfilments for a period of at least twelve (12) months after the final prize is awarded for each Entry Period.
20.5 If the Contest landing page or QR code is discontinued or replaced for any reason, or if Rift Design ceases trading, no further obligations shall exist in respect of any packaging, QR code, or printed promotional material remaining in circulation.21. Miscellaneous
21.1 The Promoter may, from time to time, publish additional rules or guidelines (for example social media posting guidelines or content usage guidelines) as separate schedules or FAQs on the Contest landing page. Those published guidelines form part of these Terms & Conditions by reference.
21.2 These Terms & Conditions may be executed in any number of counterparts and by electronic signature/acceptance.
21.3 The entrant agrees that the Promoter may contact the entrant via email, social media or telephone for the purposes of administering the Contest and verifying entry, unless the entrant has opted-out of marketing communications (see Clause 11.4).
21.4 The entrant accepts that the Promoter may transfer or assign its rights under or in respect of the prize or this Contest (for example to a third party supplier) without obtaining further consent from the entrant.
